Terms of Service

1. Acceptance of Terms
By accessing or using GPTRadar (the “Service”), available at gptradar.io, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and API consumers.
2. Description of Service
GPTRadar is a platform that monitors, benchmarks, and catalogs AI tools and models. It provides data, comparisons, alerts, and programmatic access via an API. The Service is provided on an “as is” and “as available” basis. We may add, change, or remove features at any time.
3. User Accounts and Registration
To access certain features you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service. You agree to provide accurate information and to keep it current.
4. Acceptable Use
You agree not to: (a) use automated means to extract data except through our official API within its documented limits; (b) resell, redistribute, or sublicense our data without a written agreement; (c) abuse free-tier resources or attempt to circumvent usage limits; (d) misrepresent GPTRadar benchmarks or attribute fabricated results to us; (e) attempt to gain unauthorized access to our systems; or (f) use the Service for any unlawful purpose. 5. Intellectual Property
The Service, including its benchmarks, methodology, software, design, and content, is owned by GPTRadar and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of content you submit (such as reviews and comparisons). By submitting content, you grant us a worldwide, royalty-free license to host, display, and use it to operate and improve the Service.
6. API Terms
Access to the API requires an API key and is subject to the rate limits and quotas of your plan. You must keep your API key confidential. We may suspend or revoke API access for abuse, excessive load, or breach of these Terms. API responses may not be resold as a standalone data product without a separate written agreement.
7. Subscriptions and Payment
Paid plans are billed in advance on a recurring basis. Payments are processed by third-party payment providers; we do not store full card details. Prices may change with prior notice; changes apply to the next billing cycle. You are responsible for any applicable taxes. 8. Cancellation and Refunds
You may cancel a paid plan at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain paid features until then. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial periods.
9. Data Usage and Privacy
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service you consent to that processing.
10. Disclaimers
Benchmarks and data are provided for informational purposes only and may contain errors or become outdated. We make no warranty as to accuracy, completeness, or fitness for a particular purpose. GPTRadar does not endorse any vendor; rankings reflect measured results, not commercial relationships. You are responsible for your own decisions based on our data.
11. Limitation of Liability
To the maximum extent permitted by law, GPTRadar and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our aggregate liability shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or INR 8,000.
12. Indemnification
You agree to indemnify and hold harmless GPTRadar and its operator from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.
13. Modifications to the Service and Terms
We may modify the Service or these Terms at any time. Material changes to the Terms will be notified by email or an in-product notice. Continued use after changes take effect constitutes acceptance.
14. Termination
We may suspend or terminate your access for breach of these Terms or for conduct that harms the Service or other users. You may terminate by deleting your account. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.
15. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
16. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved by arbitration seated in India under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator. Subject to arbitration, the courts of Bangalore, Karnataka shall have exclusive jurisdiction.
